1. Scope and seller
These General Terms and Conditions apply to all orders placed in the Photon Racing online shop. The seller and contracting party is Photon Racing KlG, Amselweg 13a, 3627 Heimberg, Switzerland, UID: CHE-161.460.785, phone: +41 76 205 59 53, email: info@photon-racing.com.
2. Conclusion of the contract
The presentation of products in the online shop does not constitute a binding offer but an invitation to order. Before submitting, you can check and correct your details in the checkout at any time. By submitting the order, you make a binding offer. The contract is concluded with the order confirmation, which you receive by email immediately afterwards.
3. Contract language and contract text
The contract can be concluded in German, French or English. In the event of discrepancies between the language versions of these General Terms and Conditions, the German version prevails.
We store the contract text. You receive your order details with the order confirmation by email. You can access these General Terms and Conditions at any time on our website. If you use a customer account, you can also find your orders there.
4. Prices, shipping costs and import charges
The prices displayed in the online shop at the time of the order apply. Photon Racing is not registered for VAT. Our prices therefore do not include Swiss VAT, and no VAT is shown.
Shipping costs are shown separately in the checkout and charged in addition.
Deliveries to countries outside Switzerland and Liechtenstein are made without customs clearance. On delivery, customs duties, import VAT and customs clearance fees may be charged; these are borne by the recipient. If you expressly choose a duty-paid shipping method in the checkout, these charges are included in the shipping costs and paid by us.
5. Payment
You can pay with TWINT, credit and debit cards, PayPal, Apple Pay, Google Pay and Shop Pay. The payment methods available are shown in the checkout. Payment is due when the contract is concluded and is processed in the checkout. Payments are processed by Shopify Payments, and by PayPal for PayPal payments. We ship the goods after receipt of payment.
6. Delivery and transfer of risk
We deliver to Switzerland, Liechtenstein and the countries listed in our shipping policy. Delivery times are approximate. Details can be found in the shipping policy.
We bear the risk of loss of or damage to the goods until they have been handed over to you or a person designated by you. If a shipment is lost or arrives damaged, we will send you a replacement or refund the purchase price. Please report transport damage as soon as possible to info@photon-racing.com so that we can claim it with Swiss Post.
7. Right of withdrawal
Consumers resident in the EU, in Liechtenstein, in Norway or in the United Kingdom have a statutory right of withdrawal of 14 days. Details can be found in our information on the right of withdrawal.
Customers resident in Switzerland have no right of withdrawal or return. Exchange or return of goods without defects is excluded.
8. Warranty
The warranty period is two years from delivery. Please report defects to info@photon-racing.com immediately after discovery, with photos if possible.
In the event of a defect, we will, at our discretion, deliver a replacement or repair the goods. If this is not possible or unsuccessful, you may request a price reduction or rescind the contract and receive a refund of the purchase price.
Normal wear and tear, damage caused by improper installation, overloading or modifications to the product, and manufacturing-related characteristics as described in section 9 do not constitute defects.
For consumers resident in the EU, in Liechtenstein, in Norway or in the United Kingdom, the mandatory statutory warranty rights of their country of residence remain unaffected.
9. Products, installation and safety
Our products are accessories for sim racing hardware from other manufacturers. Please check the compatibility stated in the product description before purchasing. Installation is carried out in accordance with the instructions and at your own responsibility. Modifications to devices from other manufacturers may affect their manufacturer's warranty.
Some parts are made by 3D printing. Fine layer lines and slight variations in colour and surface are due to the manufacturing process and do not constitute a defect, provided they do not impair function or stability.
Some products contain magnets. Keep these products away from persons with pacemakers or other medical implants and from magnetically sensitive items such as cards with magnetic strips and data storage media.
The products contain small parts that can be swallowed. They are not suitable for children under 3 years of age. Keep the products out of the reach of children.
Some images in the online shop were created or edited with the help of artificial intelligence. The product description is decisive for the design, colour and scope of delivery.
10. Liability
We are liable without limitation for damage that we cause intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Liability for personal injury and under the Swiss Product Liability Act remains unaffected.

Information on how we process your personal data can be found in our privacy policy.
12. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer dispute resolution body. If you have any questions or problems, please contact us directly at info@photon-racing.com.
13. Applicable law and place of jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention). For consumers resident abroad, the mandatory consumer protection provisions of their country of residence also apply.
The place of jurisdiction is Thun (Canton of Bern), unless the law provides for another mandatory place of jurisdiction. Consumers may also bring an action at their place of residence.
