This privacy policy applies to our online shop. It is based on the Swiss Federal Act on Data Protection (FADP) and, where applicable, on the General Data Protection Regulation of the European Union (GDPR).

2. Data we process

  • Order and contact data: name, delivery and billing address, email address, phone number and products ordered.
  • Payment data: payment method and payment status. We do not receive full card or account details; these are processed by the payment providers.
  • Customer account: login data and order history, if you use a customer account.
  • Communication: content of emails and chat messages as well as information about calls.
  • Technical and usage data: IP address, browser, device, pages visited, time of visit, previously visited website and data from cookies and similar technologies.
  • Newsletter: email address, time of sign-up and confirmation, and open and click data.

3. Purposes and legal bases

We process personal data for the following purposes:

  • Processing orders, payment, shipping, returns and warranty claims (Art. 6(1)(b) GDPR)
  • Customer service and communication with you (Art. 6(1)(b) and (f) GDPR)
  • Compliance with legal obligations, for example the retention of accounting records (Art. 6(1)(c) GDPR)
  • Security, fraud prevention and technical operation of the online shop (Art. 6(1)(f) GDPR)
  • Analysis of the online shop, advertising and measuring advertising performance with Google Analytics, Google Ads, the Meta pixel and the TikTok pixel, only with your consent (Art. 6(1)(a) GDPR)
  • Sending the newsletter, only with your consent (Art. 6(1)(a) GDPR)

The information on legal bases concerns persons to whom the GDPR applies.

4. Cookies and similar technologies

We use cookies and similar technologies. We always use technically necessary cookies, for example for the shopping basket, checkout and security. We only use cookies for analysis and marketing if you consent in the cookie banner. You can withdraw your consent at any time with effect for the future by changing your cookie settings or deleting the cookies in your browser.

5. Service providers and other recipients

We only disclose personal data to the extent necessary for the purposes stated. We do not sell personal data.

  • Shopify (Shopify International Limited, Dublin, Ireland, and Shopify Inc., Ottawa, Canada): operation of the online shop, checkout, customer accounts, chat (Shopify Inbox), newsletter (Shopify Email) and payment processing (Shopify Payments). If you use Shop Pay, Shopify also processes your data under its own responsibility.
  • Payment providers: depending on the payment method chosen, TWINT AG (Zurich, Switzerland), PayPal (Europe) S.à r.l. et Cie, S.C.A. (Luxembourg), Apple Pay (Apple Distribution International Limited, Cork, Ireland) or Google Pay (Google Ireland Limited, Dublin, Ireland). The data protection provisions of these providers apply to their processing.
  • Shipping: Swiss Post Ltd (Bern, Switzerland) and, for deliveries abroad, the relevant foreign postal operators and customs authorities.
  • Google Analytics and Google Ads (Google Ireland Limited, Dublin, Ireland, and Google LLC, USA).
  • Meta pixel (Meta Platforms Ireland Limited, Dublin, Ireland, and Meta Platforms, Inc., USA).
  • TikTok pixel (TikTok Technology Limited, Dublin, Ireland).
  • Authorities, courts and advisers such as our accountants or legal counsel, where we are obliged to do so or where it is necessary to protect our rights.

6. Disclosure abroad

Your personal data may be transferred to the following countries: Ireland and other EU or EEA states, the United Kingdom, Canada and the USA. With the TikTok pixel, data may also be processed in or accessed from countries such as Singapore, Malaysia or China.

According to the Swiss Federal Council, the EU and EEA states, the United Kingdom and Canada provide an adequate level of data protection. For the USA, this applies to companies certified under the Swiss-U.S. Data Privacy Framework or the EU-U.S. Data Privacy Framework. In all other cases, we rely on the standard contractual clauses of the European Commission, which are also recognised by the Federal Data Protection and Information Commissioner (FDPIC).

7. Newsletter

If you sign up for our newsletter, you will receive an email with a confirmation link (double opt-in). We only send you the newsletter after you have confirmed. You can unsubscribe at any time via the unsubscribe link in every email or by email to info@photon-racing.com. We send the newsletter with Shopify Email and analyse whether and when a newsletter was opened and which links were clicked.

8. Retention

We only retain personal data for as long as necessary for the respective purpose. We retain order and accounting records for ten years in accordance with the statutory requirements. We store newsletter data until you unsubscribe. Data from cookies remains stored until it expires or you delete it.

9. Data security

We take appropriate technical and organisational measures to protect your personal data against loss and unauthorised access. Data transmission on our website is encrypted.

10. Your rights

You have the right to request information about the personal data we hold about you, to have incorrect data corrected and data deleted, to object to processing, to receive your data in a common electronic format and to withdraw any consent given at any time with effect for the future. If the GDPR applies to you, you may also request the restriction of processing.

You can also lodge a complaint with a supervisory authority. In Switzerland, this is the FDPIC, Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch. In the EU or EEA, the supervisory authority in your country of residence is responsible.

We may amend this privacy policy at any time. The version published on this website applies.
